The range of legal issues faced by specialists in an organization is very wide. Legal navigator ConsultantPlus always helps us save time and clarify important information for several requests at once.

Step 1: Under any profile, from any window of the ConsultantPlus system, you can go to the Legal Navigator. The button of the same name is located on the panel quick access.

We make a one or two word query in the search bar. On the left, we study the required groups of concepts one by one.

Step 2: On the right, check off the key clue concepts that clarify our query (they are highlighted in color). You can select up to 5 any prompts and build a list of documents.

All found fragments are highlighted. Using the “Find” arrows above the text, we quickly move from one fragment to another, studying the document.

Introduction

Reference Legal System "Garant" (SPS) is a computer application containing complete, systematized and promptly updated information on legislation, as well as software searching, analyzing and processing this information. The main components of the SPS are: an information bank containing texts of documents and auxiliary information, as well as a software shell that provides service tools for working with the information bank. The content of the information bank of the Garant system is determined individually, depending on the information needs of each customer. In this case, a universal software shell is used, and all users interact with the system through a common interface that is uniform for all.

Let us list a number of advantages provided by electronic submission of information with preliminary legal processing of connected documents. We emphasize that all these functions are provided precisely by the careful preliminary processing of incoming documents performed by the company’s lawyers.

1. Compact storage of information. SPS helps to compactly store documents and analytical materials necessary for work. Special data processing makes it possible to fit into a relatively small database more than a million documents that make up large sets of the Garant system. The number of documents in the current database can be seen in the window Kit information.

2. Search for a specific document. ATP is a tool for quickly searching for the necessary documents among the millions that make up legislation. Having information about the document details, you will find it using the tool Search by details. It will help to gain access to consultation materials published in the media.

3. Search for documents by branches of legislation. All legal information included in the Garant system is classified according to a single general legal classifier. The legal navigator allows you to carry out a sequential transition through the tree structure of the classifier, in which the range of issues covered is clarified step by step. As a result, a list of documents regulating the legal topic selected by the user during the navigation process is displayed.


4. Search for documents based on the situation. "Garant" provides a search for documents describing a practical problem. Even without having information about the document details, you can easily get a selection of legislative acts that answer a specific question. To do this, just select one or more situations in the window Search by situation.

5. Receipt additional information about the document. The ATP user has access to its relationships, history of changes, comments from lawyers of the Garant system and other analytical information about the document. A description of all possibilities is provided on the pages of the section Documentation.

6. Prompt updating of the entire array of documents. Telecommunications updates performed via the Internet allow you to receive new documents almost the same day they are released.

1. Start and end of work

1.1. Launch of the Garant F1 system

If you are using a file management program ( Far Manager), you must select network drive N: and run the file: garant. exe. If you are using the Desktop, then you need to select the My Computer icon, then follow the following path: GarantF1 on "Fileserver" (H:)\garant. exe. To quickly call the system, you can assign a key combination or create a shortcut on the Desktop. You can learn about these features from your Windows documentation. If the Garant system is launched on your computer for the first time, it will either prompt you to register or do it on its own. This will create a new system user profile, which is necessary to store your personal data.

Self-registration in the system allows you to create a user profile by selecting a personal login and password to enter Garant. To register, click the link New user b in the registration window. The system will offer to fill out a number of fields, following simple rules. Continued work will be possible after correctly filling in all the required fields (Fig. 1).

The main menu contains the following blocks: Legal navigator, reference Information, Latest open documents , Search by details, Search by situation, Search by publication source, Dictionary.

2.1. Navigation bar

Left Main window located Navigation bar ( rice. 3), which contains a dynamic set of tabs for managing the system as a whole and various objects opened during operation. Navigation bar contains the following sections (by default): Menu, My Documents. If necessary, you can connect such sections as: List of configurations, Documents under control, Filters.

Switching between pages is done using tabs. Not all tabs are always present in the navigation bar. Most of them appear only when working with certain objects. To avoid cluttering the navigation bar, these tabs are automatically hidden when you navigate to other pages.

For example: 1) the filters tab is shown when working with a list of documents, 2) the tab with the table of contents of the document is relevant only when viewing the text of the document, and 3) the tab with document revisions appears if in this document changes were made.

You can hide any of the tabs by using the cross button in the upper right corner of the tab. To return a hidden tab, you need to call the command of the same name from the main menu of the system.

The system provides many controls for the navigation bar. You can organize your workspace in a way that is convenient for you by performing the following manipulations:

1. Changing the width. Performed using the mouse by moving the separator between Navigation bar And Main window systems.

Navigation bar will switch to auto-fold mode. In this mode, the panel automatically collapses when the mouse cursor is outside the panel and expands when the mouse cursor hovers over a panel tab.

4. Switch to floating mode. Grab the panel title (the two-bar divider at the top of the panel) with your mouse and drag it anywhere on the screen. The panel will detach and go into floating mode (Fig. 4). The panel can be attached back to the main window by dragging it by its title to the left or right edge of the window.

Visually, the navigator is presented in two equivalent views, shown in the illustration: in the tree view (in the navigation panel) and in the main window. In the first view, you can expand and look at all levels of the classifier, while in the second, the content of only one level is displayed. You can use any of them in your work.

2. Judicial and arbitration practice. Includes decisions of the Constitutional Court, the Supreme Arbitration Court of the Russian Federation, the Supreme Court of the Russian Federation, Federal Arbitration Courts of Districts and courts of the constituent entities of the Federation. This information is necessary not only for professional lawyers, but also for everyone involved in concluding contracts and resolving disputes. It is not always possible to unambiguously determine the procedure for applying a normative act. It is in such situations that a selection of judicial practice, which is a guideline in the application of the law, is indispensable.

3. International treaties. This section includes conventions, declarations, international covenants, multilateral and bilateral treaties between Russia and other countries, including the countries of the Commonwealth of Independent States. International agreements ratified by the laws of the Russian Federation are an integral part of its legal system. According to the Constitution, international law takes precedence over domestic law. Thus, when an accountant studies issues of taxation of transactions with foreign legal entities he will need not only the texts of Russian regulations, but also relevant documents of international law (for example, on the avoidance of double taxation).

4. Explanations, comments, diagrams. These are analytical materials developed by well-known specialists or publishing houses in the field of law and accounting. Author's materials allow you to obtain not only links to the regulations necessary for study, but also detailed, competent explanations on their correct application. It is important to emphasize that over time, changes in legislation inevitably occur, and a number of comments, clarifications, and diagrams partially or completely lose their relevance. Therefore, when making a decision, you should be guided by current regulations.

5. Draft laws. The bills in this section are accompanied by explanatory notes from their authors, from which one can determine what the legislator wants to get as a result of the adoption of a particular law. In addition, the system tracks the fate of each bill from the moment it is submitted for consideration to the moment it is signed, reflected in the dossier for the bill.

6. Document forms. Contains standard forms of documents in various formats (Txt, Word, Excel): contracts, powers of attorney, forms of accounting, tax and statistical reporting approved by government bodies. This also includes contract forms drawn up by GARANT lawyers.

Reference Information. The reference information contains news and reviews of legislation, business references, an accountant's tax calendar, as well as information about new documents and hot information about services.

1. Business information. Frequently used economic and legal information collected in one place. The business information section contains a production calendar, tax and accounting reporting forms, dynamics of changes in the minimum wage, Central Bank exchange rates and refinancing rates, a BIC directory and other thematic collections of information. For example, the minimum wage has changed two dozen times in recent years. To change it, the same number of regulations were adopted. To track the dynamics of changes in the minimum wages, you need to find and study all these documents. Having the appropriate business certificate greatly simplifies this work. Legislation monitoring is an overview of the most important changes in legislation over the past 6 weeks, as well as information about new products in analytical information blocks. The list of documents is divided by subject. The most important documents are marked with a comment Attention.

Computer reference legal system Consultant Plus (SPS K+) is software package, which includes an array of legal information and software tools that allow a specialist to work with this array of information (search for specific documents or their fragments, analyze them and print information).

SPS K+ - provides information services, and the user must make final decisions on legal issues independently.

SPS K+ is a media outlet, but not an official source of publication, which must be taken into account when contacting official bodies; at the same time, ATP K+ contains information about where this or that normative document, which allows the user to quickly find an official source if necessary.

The ConsultantPlus system is constantly evolving: new opportunities appear every year that increase the efficiency of specialists. Reliability software technologies ConsultantPlus has been repeatedly confirmed by Microsoft certificates for compatibility with Windows operating systems. The high level of quality of design, development and maintenance of SPS K+ is also confirmed by a certificate.

The legal reference system ConsultantPlus provides access to the most different types legal information: from regulations, materials of judicial practice, comments on documents, bills, financial consultations, schemes for reflecting transactions in accounting to reporting forms and highly specialized documents.

For ease of information retrieval, all documents are contained in the ConsultantPlus Unified Information Array (EIM). This allows you to search for the necessary documents without worrying about what type of information they relate to, and create your own collections of documents related to different types of legal information. Documents of each type have their own specific features, therefore, for the convenience of working with information, the entire IIM is divided into nine sections, each of which contains one or more information banks (IB) that are similar in content.

Launching the ConsultantPlus system is no different from launching any WINDOWS application and is carried out by double-clicking on the “ConsultantPlus” shortcut. After starting the system, the Start window appears on the screen, from where you can go to various parts of the Consultant Plus system, depending on the task.

Work in SPS K+ is divided into several stages:

search for necessary documents;

studying the list of found documents;

working with document text.

In the Start window, clicking on the title of the “Legislation” section opens a search window. By default, the “Search Card” opens - the main search tool. In addition to the search card, the window has tabs (other search tools):

« Quick search" - is a string for entering a query (as in Internet search engines). You can start searching immediately after launching ConsultantPlus, already from the Start window, without wasting time selecting the required section of the system and Search Card fields. Just click on the link to Quick Search in the Start window. Quick search is also easily accessible from anywhere in the program thanks to the Quick Access Panel - you just need to click on the Quick search button at the top of the working window

"Legal Navigator". Using the Legal Navigator, you can search for information on a specific legal issue;

"Reference Information". This tab can also be accessed from the “Start Window” using the “Reference Information” link. Use this tab to find frequently used reference information;

"Reviews". This tab can also be accessed from the Start window via the “Reviews” link. This tab is used for news and legislative reviews;

"Codes". This tab can also be accessed from the Start window via the “Codes” link. This tab is used to instantly go to the list of all codes of the Russian Federation in current editions,

“Guides” is a list of links to documents prepared by ConsultantPlus specialists, which help users solve various professional issues without wasting time on independent search and analysis of information. The guides contain essential information on a wide range of practical issues - conclusions, options, court positions, examples and links to documents. Guides are regularly updated to reflect changes in legislation. The ConsultantPlus system provides Guides for all main user groups: for accountants, for personnel officers, for lawyers.

“Dictionary of Terms” - contains not only terms whose definitions are given in regulations (for example, the definition of the term “tax” is given in the Tax Code of the Russian Federation, it is this that is used in the dictionary) but also additionally contains terms widely used in business. Dictionary is regularly updated with new terminology.

In addition, the search window has tabs “Folders”, “Bookmarks” and “History”.

The ConsultantPlus system provides three standard menu types:

1) the main menu, its commands are located on the top line of the screen;

2) pictographic menu (button panel) located under the main one;

3) context menu, called by pressing the right mouse button at a specific location on the screen.

An important tool for using the ConsultantPlus system is the built-in help system (F1).

Guarantee

Development information system"Garant" is handled by the company "Garant-Service". Development of the program began in August 1990. The first version of the Garant SPS was presented in 1991.

When connecting each new document to the Garant system, a full cycle of legal processing is carried out.

After transfer to electronic view Each document is tested for authenticity to the official text. The proofreaders check it twice.

Before connecting to the information bank, each document is subjected to preliminary legal processing:

record all his details for quick and easy search using the request card;

provide a certificate that contains the full name of the document, the name of the body that adopted it and the date of adoption, the number and date of registration with the Ministry of Justice, the procedure for entry into force, a list of official publications and a list of all changes to the document;

place the document in a certain section of the classifier;

connect to search by situation.

Experts from the legal department conduct a full legal analysis of the document regarding its relationship with the entire body of legislation. Changes and additions are made, contradictions are identified, complex formulations are clarified, hidden connections are established between documents that do not have formal links to each other, and lists of corresponding respondents are automatically built.

The Garant system has powerful search tools that allow you to quickly find the necessary legal information. The choice of search type depends on what preliminary information you have about the issue or document you are interested in. The correct choice largely determines the accuracy and speed of the search.

Information about the existing kit can be obtained by selecting help/kit information in the top menu, and to get help on working with the system, just select Help/Contents or press the standard F1 key. Menu/File/Configuration Settings allows you to configure the system interface.

The system has the following types of search (for example, when you click on a button on the toolbar or on the navigation bar):

basic search;

search by details – search with exact details;

search by situation – search with a description of the real situation;

search in the explanatory dictionary.

Basic Search is a very powerful and at the same time simple search tool. This is GARANT know-how, created in 2007 and constantly improved. Basic Search allows you to instantly and accurately find the information you need with just one line of query. He understands not only the official, but also the living language of professionals - abbreviations, abbreviations, professional terms and even slang. Start typing your query, and the Dictionary of Popular Queries will immediately tell you how to formulate it more precisely. Select the desired wording from the dictionary - the answer will appear instantly.

Search by details is used if any details are known (number, name, date, authority that issued the document, or other details). Search by details is a precise tool designed to search for documents using previously known (or assumed) information about the document.

Search by situation is used if it is not known which documents contain the answers to your questions. Search by situation is a unique patented development of the Garant company. The encyclopedia of situations "Garant" contains over 100,000 detailed terms ("Garant-Maximum. All Russia"). Thanks to the Encyclopedia of Situations, any person who is not an expert in the field in question and does not know the details of the regulatory act can find the answer to his question in a huge array of data and select documents that describe the situation. Using familiar terms, they formulate questions and enter the initial parts of words in any sequence in the context filter field. As a result, all situations whose names correspond to the typed context will be clearly presented in the main window of the system.

A search in an explanatory dictionary is used if you need to look up the interpretation of words. Unlike document searching, interpretation searching is designed to obtain an interpretation of a term or terminological expression. The search is performed in the explanatory dictionary of terms built into Garant. The dictionary contains interpretations of tens of thousands of terms on economic and legal topics. Sources are domestic and foreign encyclopedias, specialized reference books, explanatory dictionaries and definitions from regulations.

The reference information section of the main menu is used to quickly find reference information (reporting forms, tax rates, exchange rates, addresses and telephone numbers of authorities, and much more).

Legal navigator is a tool for intelligent search of documents on a specific issue. With its help, you can find the main current legal acts, as well as materials from judicial practice and financial advice on the issue under consideration. The list of documents found using the Legal Navigator contains current documents and documents that will soon come into force.

The legal navigator is a classifier, the development of which used a fundamentally new, legally strict methodology that ensures objectivity, rigor and accuracy of the search for documents of interest to the user.

The dictionary of key concepts is built on the basis of system-forming legal acts, which are the foundation for solving legal, financial and economic issues. It is constantly evolving as the legislation itself develops. For ease of use, related key concepts are combined into groups of concepts.

You can go to the Legal Navigator directly from the Start window using the appropriate link, as well as from the Search Card through the tab of the same name in the search window.

This opens the Legal Navigator dictionary, which is visually presented in two windows, which corresponds to its two-level structure: key concepts combined into groups of key concepts. The left window displays groups of concepts in alphabetical order, the right window displays key concepts that correspond to the active one in currently group of concepts (i.e. the group of concepts on which the cursor is located). In addition, the name of the active group is duplicated at the top of the legal field above the list of key concepts for this group. Each key concept from a certain group of concepts corresponds to a list of documents on this topic. Thus, the “concept group/key concept” pair gives an exact indication of the documents being searched.



This two-window interface is standard interface for operating room Windows systems. For example, Windows Explorer has a two-window interface.

The legal concepts you are looking for are typed into the search bar. Words should be written in full. As noted above, to search for a collection of documents, you need to specify the “concept group/key concept” pair.

To search for these pairs, a filter is provided, which, in comparison with the filters in the Search Card dictionaries, has two important features associated with the two-window interface of the Legal Navigator.

First feature consists in the fact that filtering (selection of key concepts) is carried out taking into account the occurrence of the values ​​specified in the search string and the “concept group/key concept” pair.

Second feature is that the selection of elements always occurs only in the left window of the Legal Navigator (among groups of key concepts); in the right window, only the searched key concepts are highlighted without reducing the list of concepts from the corresponding group. Key concepts that match the query are moved to the top of the list. Below them are the remaining concepts of the group. This allows the user to see what other key concepts there are that, although they do not coincide verbatim, are close to the concepts being sought, and, if necessary, select them. The fact is that key concepts are very detailed and different aspects of one question can relate to several key concepts of the same group, so strict selection of key concepts by user-specified values ​​in the search string could lead to the loss of information necessary for the user. Selecting only among groups of concepts does not pose such a danger, since groups of concepts describe fairly large issues.

Recommendations.Enter in the search bar, for example, VAT RATES. As a result, for example, a group of concepts will remain VAT, in which the key concept will be highlighted TAX RATE: The first of the given words is included in the group name, and the second is included in the key concept. (Also note that the highlighted key concept contains the word RATES in a different grammatical form.)

When searching for key concepts, you should try to enter in the search bar those words that most accurately describe the problem you are looking for. You should not ask too many words, otherwise there is a high probability that the given word will not be included in the key concept. Words should be specified in full. In this case, the system itself will take into account possible endings of words in the names of key concepts and their groups. You can set generally accepted abbreviations, for example, VAT, LLC, JSC, OSAGO, VUZ, etc.

Recommendations. Enter the word in the search bar OSAGO. A group will be selected GENERAL CIVIL LIABILITY INSURANCE. The abbreviation itself does not appear either in the name of the group or in the key concepts of this group. You can combine a demonstration of working with abbreviations with performing a search example. Please note that very often the full name of the term and its abbreviation are duplicated in the name of a group of concepts or key concepts. Therefore, for clarity of display, select the option where the abbreviation does not appear in the title.

To select a key concept or group, check the box to the left of the key concept or group name, respectively. You can specify several key concepts or groups. In this case, they are connected by a logical condition by default OR: documents will be found that match at least one of the selected key concepts or groups.

For quick navigation in the left window (by groups of key concepts), you can use the alphabetical index.

If necessary, you can clear the list of selected concepts using the button.

To build a list of documents that meet the selected key concepts, click the button.

The ConsultantPlus system implements the possibility of a so-called universal search in the text of a document, which allows you to quickly find fragments of text that interest the user. We first met her when studying topic 4: if we used the “Document Text” field when searching for a document, then when entering the document we automatically find ourselves in the first fragment containing the words specified in the “Document Text” field. Then we can easily find all other such fragments by clicking the button the top part of the window, to the right of the field in which the search words are indicated (universal text search field).

When using the Legal Navigator, the possibility of a universal text search allows, when entering a document, to immediately go to a fragment that corresponds to one of the specified key concepts (in other words, go to the document at the entry point corresponding to the specified key concepts; note that the entry point is marked with a special icon on the left from the corresponding fragment of text).

In 1992, NPO VMI released a new generation legal system - SPS Consultant Plus. This development took into account the experience of previous decades and at the same time contained new solutions. Full-text search is “an automated document search in which its full text or significant parts of the text are used as a search image of a document” (7). In ATP, full-text search is a software-implemented search for words or combinations of characters directly in the text of database documents. This type of search is carried out in the absence of precise data about the document. To increase the speed of the process, index dictionary information is used. The possibility of this type of search is based on full-text automated indexing of documents, in which all words found in texts are automatically entered into the dictionary, indicating the document number where the word was found. Such a dictionary is structured in alphabetical order, but differs from an alphabetical index in that it automatically includes all words from texts, and not specially selected legal terms. Full-text search for words and phrases in SPS is an automatic search based on the use of a dictionary of this type. Automatic technique selection of documents requires an intellectual approach from the bibliographer and user when forming search query, the presence of several query options using various synonymous terms and definitions.

The main difficulty is that in most cases, users require documents without the exact details known in advance, only on the basis of the general meaning of the problem. The full-text search strategy, depending on the situation, determines the choice of the most optimal search algorithm. ATPs make it possible to implement thematic (problematic) and contextual (approximate) search capabilities in the case when the general thematic focus of documents is known. Thematic search results are most effective in situations where the problem or its boundaries are inaccurately or unclearly defined. The contextual search type is recommended in the following cases:

Inability to accurately formulate a search query;

Difficulties in defining the exact legal terms that characterize this or that problem, the need to obtain a maximum of documents, even remotely related to the problem of interest.

Sometimes the final result of a contextual search in the form of a list of documents may include, in addition to important ones, irrelevant and random ones. For example, in the list of documents for the request "State symbols Russian Federation“, along with the fundamental laws “On the State Emblem of the Russian Federation”, “On the State Flag of the Russian Federation”, “On the State Anthem of the Russian Federation”, Federal Law No. 99-FZ of July 15, 2000 “On Plant Quarantine” is indicated, where Article 17 reads: “State The plant quarantine service of the Russian Federation has a flag, pennant and identification mark..."

Each type of search has its own advantages and disadvantages, advantages and limitations when used. The greatest efficiency is achieved by combining various types search.

For example, when performing a request to search for regulations that stipulate permission for drivers of category “C” to drive a car with a trailer weighing over 750 kg, search in such well-known documents as “Road Rules” and Federal Law No. 196- Federal Law as amended dated 03/02/99 “On road safety”, positive results did not give. When referring to classifiers and a situational reference book using the keywords “motor transport - road traffic,” a list of 72 documents was generated, of which 53 were valid. By title, none of the documents were relevant. A complete review would require a significant amount of time for the bibliographer. In this case, using the “document text” attribute, a clarifying request was formulated using the logical operator “AND” - “750 car* trailer*”. As a result of the search, Resolution of the Government of the Russian Federation No. 1396 dated December 15, 1999, as amended, was found. dated November 21, 2001 No. 808 “On approval of the rules for passing qualification exams and issuing driver’s licenses”, where clause 7 allowed drivers who have the right to drive vehicles category "C" "... drive them also in the presence of a trailer, the permissible maximum weight of which does not exceed 750 kilograms."

As a result of preliminary legal processing, all documents are accompanied by a set of additional information that allows you to navigate the legislation and track the dynamics of its development. Legal processing is the identification of relationships between documents, recording identified connections using links, notes, reference information, as well as creating revisions of documents when they are changed. It is the legal processing of the document when entering it into the PDB that creates real prerequisites for the user to quickly find the required document.

When working with the current edition of a particular normative act, the user can immediately obtain information about retrospective editions of the document, determine the respondent and correspondent connections of the document, a link to the source of publication in the form of a bibliographic description, read the comments on the document. Legal processing of documents also helps to identify contradictions in the norms of various documents, guides the user in thematic headings and keywords. In general, SPS create a new scheme for presenting information in the form of a hypertext implementation on related documents, moving from one document to another using links.

Search capabilities, advanced navigation systems, and unique technological solutions embedded in the SPS allow us to talk about the transformation of the activities of a bibliographer, which previously involved the use of only a traditional reference and retrieval apparatus. ATPs are convenient and effective means organization of work of bibliographers related to the provision of legal information. Currently, we can say that the ATPs themselves are part of the reference and retrieval apparatus of libraries. The active introduction into practice of electronic resources, of which SPS are an integral part, opens up new opportunities for bibliographic services and provides new search tools, inviting the user to constantly expand their arsenal of working with legal information.
